Door een bestelling te plaatsen bij Mini Botanica ga je akkoord met onze algemene voorwaarden.

Wij doen er alles aan om je bestelling zorgvuldig, snel en correct te verwerken.

Deze algemene voorwaarden zijn opgesteld in het Nederlands. In geval van verschillen tussen vertalingen en de Nederlandse tekst,

is de Nederlandse versie leidend.

Artikel 1 – Definities 

In deze voorwaarden wordt verstaan onder: 

Ondernemer: Mini Botanica, gevestigd te Vlagtwedde. 

Klant: iedere natuurlijke persoon of rechtspersoon die een overeenkomst aangaat met Mini Botanica. 

Consument: een natuurlijke persoon die handelt voor doeleinden buiten zijn bedrijfs- of beroepsactiviteiten. 

Overeenkomst: iedere overeenkomst tussen Mini Botanica en de klant die via de webshop tot stand komt. 

Producten: alle goederen die via de webshop worden aangeboden, waaronder levende planten en niet-levende accessoires. 

Artikel 2 – Toepasselijkheid 

  1. Deze algemene voorwaarden zijn van toepassing op alle aanbiedingen, bestellingen en overeenkomsten via de webshop van Mini Botanica. 
  2. Door het plaatsen van een bestelling verklaart de klant akkoord te gaan met deze voorwaarden.  
  3. Afwijkingen van deze voorwaarden zijn alleen geldig indien schriftelijk overeengekomen.  

Artikel 3 – Aanbod 

  1. Alle aanbiedingen op de website zijn vrijblijvend.  
  2. Kennelijke fouten, vergissingen of schrijffouten in prijzen, afbeeldingen of productinformatie zijn niet bindend voor Mini Botanica.  
  3. Afbeeldingen dienen uitsluitend ter illustratie. Omdat planten natuurproducten zijn, kunnen deze afwijken van de getoonde foto's.  

Artikel 4 – Totstandkoming van de overeenkomst 

  1. De overeenkomst komt tot stand op het moment dat de klant een bestelling plaatst en deze door Mini Botanica wordt bevestigd.  
  2. Mini Botanica behoudt zich het recht voor een bestelling te weigeren of aanvullende informatie op te vragen.  

Artikel 5 – Prijzen 

  1. Alle vermelde prijzen zijn inclusief btw tenzij anders vermeld.  
  2. Eventuele verzendkosten worden duidelijk weergegeven voordat de bestelling wordt afgerond.  
  3. Mini Botanica behoudt zich het recht voor prijzen te wijzigen. Prijswijzigingen hebben geen invloed op reeds geplaatste bestellingen.  

Artikel 6 – Betaling 

  1. Betaling dient plaats te vinden via de aangeboden betaalmethoden.  
  2. Beschikbare betaalmethoden kunnen onder meer zijn:

  4. iDEAL in3  
  5. Bancontact  

  Bestellingen worden verwerkt nadat de betaling succesvol is ontvangen.  

Artikel 7 – Levering 

  1. Mini Botanica streeft ernaar bestellingen zo spoedig mogelijk te verwerken en te verzenden.  
  2. Vermelde levertijden zijn indicatief.  
  3. Levende planten worden uitsluitend verzonden op maandag en dinsdag om de kwaliteit tijdens transport te waarborgen.  
  4. Mini Botanica is niet aansprakelijk voor vertragingen veroorzaakt door vervoerders.  
  5. Indien een bestelling niet of slechts gedeeltelijk geleverd kan worden, wordt de klant hierover zo spoedig mogelijk geïnformeerd.  

Artikel 8 – Levende planten (aanvulling) 

  1. Garantie op levende planten 
  2. Mini Botanica staat ervoor in dat planten bij verzending gezond en in goede conditie worden geleverd.  Omdat planten levende producten zijn die afhankelijk zijn van verzorging, standplaats, temperatuur, licht, luchtvochtigheid en watergift, kan Mini Botanica geen garantie geven op de ontwikkeling of conditie van een plant na ontvangst.  
  3. Eventuele problemen met de conditie van een plant dienen binnen 48 uur na ontvangst gemeld te worden via info@minibotanica.nl, voorzien van duidelijke foto's.  
  4. Na verloop van 14 dagen na ontvangst kan Mini Botanica niet meer beoordelen onder welke omstandigheden de plant is gehouden. Om die reden kunnen klachten over de gezondheid of conditie van een plant die na deze termijn ontstaan in principe niet meer in behandeling worden genomen.  
  5. Dit laat de wettelijke rechten van consumenten met betrekking tot producten die bij levering niet aan de overeenkomst voldeden onverlet.  
  6. Deze laatste zin ("Dit laat de wettelijke rechten... onverlet") is belangrijk. Daarmee voorkom je dat de bepaling ongeldig wordt verklaard omdat je wettelijke consumentenrechten probeert uit te sluiten. 

Artikel 9 – Herroepingsrecht 

Niet-levende producten 

  1. Consumenten hebben het recht de overeenkomst zonder opgave van redenen te ontbinden binnen 14 dagen na ontvangst van het product.  
  2. Binnen deze termijn dient de consument per e-mail aan info@minibotanica.nl kenbaar te maken gebruik te willen maken van het herroepingsrecht.  
  3. Vermeld daarbij:  
  4. Naam;  
  5. Ordernummer;  
  6. Product(en);  
  7. Eventuele reden van retour (niet verplicht).  
  8. De consument ontvangt vervolgens retourinstructies.  
  9. Na aanmelding heeft de consument nog 14 dagen om het product terug te sturen.  

Voorwaarden retourzending 

  1. Het product dient ongebruikt te zijn.  
  2. Het product dient, indien redelijkerwijs mogelijk, in originele staat en verpakking te worden geretourneerd.  
  3. De directe kosten van retourzending zijn voor rekening van de consument.  

Terugbetaling 

  1. Na ontvangst en controle van de retourzending wordt het aankoopbedrag inclusief de oorspronkelijke standaard verzendkosten uiterlijk binnen 14 dagen terugbetaald.  
  2. Mini Botanica mag wachten met terugbetaling totdat de retourzending is ontvangen of totdat bewijs van verzending is overgelegd.  
  3. Terugbetaling vindt plaats via dezelfde betaalmethode waarmee de bestelling is betaald.  

Artikel 10 – Uitsluiting herroepingsrecht voor levende planten 

Op grond van artikel 6:23 0p Burgerlijk Wetboek is het wettelijke herroepingsrecht uitgesloten voor levende planten en andere producten die: 

  • Snel kunnen bederven;  
  • Een beperkte houdbaarheid hebben;  
  • Vanwege hun aard niet geschikt zijn voor retourzending.  

Daarom kunnen levende planten niet worden geretourneerd.

Artikel 11 – Klachten 

  1. Klachten over producten of dienstverlening dienen binnen een redelijke termijn na ontdekking van het gebrek te worden gemeld.  
  2. Voor schade aan planten tijdens transport geldt een meldingstermijn van 48 uur na ontvangst.  
  3. Klachten kunnen worden ingediend via info@minibotanica.nl.  
  4. Mini Botanica streeft ernaar binnen 5 werkdagen inhoudelijk te reageren.  
  5. Indien een klacht niet in onderling overleg kan worden opgelost, kan de consument gebruikmaken van het Europese ODR-platform:

Artikel 12 – Aansprakelijkheid 

  1. Mini Botanica is uitsluitend aansprakelijk voor directe schade die het gevolg is van opzet of bewuste roekeloosheid.  
  2. De aansprakelijkheid van Mini Botanica is beperkt tot het bedrag van de betreffende bestelling.  
  3. Mini Botanica is niet aansprakelijk voor indirecte schade, gevolgschade of gederfde winst.  

Artikel 13 – Overmacht 

  1. Mini Botanica is niet gehouden verplichtingen na te komen indien dit onmogelijk is door overmacht.  
  2. Onder overmacht wordt onder meer verstaan:  
  3. Extreme weersomstandigheden;  
  4. Ziekte;  
  5. Storingen bij vervoerders;  
  6. Internet- of betalingsstoringen;  
  7. Overheidsmaatregelen;  
  8. Andere omstandigheden buiten de invloed van Mini Botanica.  

Artikel 14 – Privacy 

  1. Mini Botanica verwerkt persoonsgegevens uitsluitend in overeenstemming met de geldende privacywetgeving (AVG).  
  2. Persoonsgegevens worden uitsluitend gebruikt voor:  
  3. Het verwerken van bestellingen; 
  4. Klantenservice; 
  5. Wettelijke administratieve verplichtingen;  
  6. Communicatie met betrekking tot de bestelling.  
  7. Persoonsgegevens worden niet verkocht aan derden.  
  8. Meer informatie is opgenomen in het Privacybeleid van Mini Botanica.  

Artikel 15 – Toepasselijk recht 

  1. Op alle overeenkomsten is uitsluitend Nederlands recht van toepassing.  
  2. Geschillen worden voorgelegd aan de bevoegde rechter in Nederland.

We make every effort to process your order carefully, quickly, and correctly. 

These Terms & Conditions have originally been drafted in Dutch. In the event of any discrepancy or difference in interpretation between translations and the Dutch version, the Dutch version shall prevail.

Article 1 – Definitions 

In these Terms & Conditions, the following definitions apply: 

Seller: Mini Botanica, established in Vlagtwedde, The Netherlands. 

Customer: Any natural person or legal entity entering into an agreement with Mini Botanica. 

Consumer: A natural person acting for purposes outside their trade, business, or profession. 

Agreement: Any agreement concluded between Mini Botanica and the Customer through the webshop. 

Products: All goods offered through the webshop, including live plants and non-living accessories. 

 

Article 2 – Applicability 

  1. These Terms & Conditions apply to all offers, orders, and agreements concluded through the Mini Botanica webshop.  
  1. By placing an order, the Customer agrees to these Terms & Conditions.  
  1. Any deviation from these Terms & Conditions shall only be valid if agreed upon in writing.  

Article 3 – Offers 

  1. All offers displayed on the website are non-binding.  
  1. Obvious errors, mistakes, or typographical inaccuracies in prices, images, or product descriptions shall not bind Mini Botanica.  
  1. Images are for illustrative purposes only. As plants are natural products, they may differ from the photographs shown.  

 

Article 4 – Formation of the Agreement 

  1. The Agreement is concluded when the Customer places an order and Mini Botanica confirms the order.  
  1. Mini Botanica reserves the right to refuse an order or request additional information before accepting it.  

 

Article 5 – Prices 

  1. All prices displayed on the website include VAT unless stated otherwise.  
  1. Any shipping costs will be clearly displayed before the Customer completes the order.  
  1. Mini Botanica reserves the right to modify prices. Price changes do not affect orders already placed and confirmed.  

 

Article 6 – Payment 

  1. Payment must be made using one of the payment methods offered on the webshop.  
  1. Available payment methods may include:  
  1. iDEAL  
  1. iDEAL in3  
  1. Bancontact  
  1. Wero  
  1. Orders will only be processed after successful payment has been received.  

 

Article 7 – Delivery 

  1. Mini Botanica aims to process and dispatch orders as quickly as possible.  
  1. Delivery times are estimates and cannot be guaranteed.  
  1. Live plants are shipped exclusively on Mondays and Tuesdays to maintain plant quality during transit.  
  1. Mini Botanica is not liable for delays caused by shipping carriers or delivery services.  
  1. If an order cannot be fulfilled in whole or in part, the Customer will be informed as soon as possible.  
  1. The risk of loss or damage to Products passes to the Customer once the order has been delivered to the specified delivery address.  

 

Article 8 – Live Plants 

Warranty and Plant Condition 

  1. Mini Botanica guarantees that plants are healthy and in good condition at the time of shipment.  
  1. As plants are living products whose development depends on care, location, temperature, light exposure, humidity, and watering, Mini Botanica cannot guarantee the condition or development of a plant after delivery.  
  1. Any issue regarding the condition of a plant must be reported within 48 hours of delivery by emailing info@minibotanica.nl and providing clear photographs.  
  1. After 14 days from delivery, Mini Botanica can no longer assess the conditions under which the plant has been kept. For this reason, complaints regarding the health or condition of a plant arising after this period will generally not be considered.  
  1. This provision does not affect any statutory rights consumers may have regarding products that did not conform to the Agreement at the time of delivery.  

 

Article 9 – Right of Withdrawal 

Non-Living Products 

  1. Consumers have the right to withdraw from the purchase of non-living products within 14 days of receiving the Product, without giving any reason.  
  1. To exercise this right, the Consumer must notify Mini Botanica by email at info@minibotanica.nl within the withdrawal period.  
  1. The notification should include:  
  1. Customer name;  
  1. Order number;  
  1. Product(s) to be returned;  
  1. Reason for return (optional).  
  1. Mini Botanica will then provide return instructions.  
  1. After notifying Mini Botanica, the Consumer has an additional 14 days to return the Product.  

Return Conditions 

  1. Products must be returned unused.  
  1. Products should be returned in their original condition and packaging where reasonably possible.  
  1. Return shipping costs are the responsibility of the Consumer.  

Refunds 

  1. Upon receipt and inspection of the returned Product, Mini Botanica will refund the purchase amount, including standard shipping costs, within 14 days.  
  1. Mini Botanica may delay reimbursement until the returned Product has been received or proof of shipment has been provided.  
  1. Refunds will be made using the same payment method used for the original transaction.  

 

Article 10 – Exclusion of the Right of Withdrawal for Live Plants 

Pursuant to Article 6:230p of the Dutch Civil Code, the statutory right of withdrawal does not apply to live plants and other products that: 

  • are liable to deteriorate rapidly;  
  • have a limited shelf life;  
  • are unsuitable for return due to their nature.  

For this reason, live plants cannot be returned. 

If you are dissatisfied with a plant you have received, please contact us at info@minibotanica.nl and we will gladly work with you to find a suitable solution. 

Article 11 – Complaints 

  1. Complaints regarding Products or services should be submitted within a reasonable period after the issue has been discovered.  
  1. Damage to plants during transport must be reported within 48 hours of delivery.  
  1. Complaints can be submitted by email to info@minibotanica.nl.  
  1. To assess a complaint properly, Mini Botanica may request clear photographs of the Product and its packaging.  
  1. Mini Botanica aims to provide a substantive response within 5 business days.  
  1. Consumers within the European Union may also submit complaints via the European Commission's Online Dispute Resolution platform:

Article 12 – Liability 

  1. Mini Botanica shall only be liable for direct damages resulting from intent or gross negligence.  
  1. Any liability of Mini Botanica shall be limited to the amount paid for the relevant order.  
  1. Mini Botanica shall not be liable for indirect damages, consequential damages, or loss of profit.  

rticle 13 – Force Majeure 

  1. Mini Botanica shall not be required to fulfill any obligation if performance is prevented by force majeure.  
  1. Force majeure includes, but is not limited to:  
  1. extreme weather conditions;  
  1. illness;  
  1. disruptions affecting carriers or delivery services;  
  1. internet or payment system failures;  
  1. government measures;  
  1. any circumstances beyond the reasonable control of Mini Botanica.  

Article 15 – Availability 

  1. Despite careful inventory management, a Product may occasionally become unavailable.  
  1. If an ordered Product is unavailable, the Customer will be informed as soon as possible.  
  2. Any amount already paid will be refunded using the original payment method.
